As of the 1st
July 2007, it will be against the law to smoke in almost all
public places, workplaces and public and work vehicles, with very
few exemptions.
Who is responsible?
All managers
of smokefree premises and vehicles will
be legally responsible to prevent people from smoking.
Which places must be smokefree?
The ban will apply in:
-
Any enclosed or substantially enclosed
workplace where more than one person works.
-
Public transport, taxis, company vehicles.
-
Any enclosed or substantially enclosed public
places.
Are there exemptions from the ban?
-
Homes are exempt as long as they are not used
as a place of work, employing staff.
-
Designated smoking rooms are exempt in care
homes, hospices, long stay mental health units, hotel bedrooms,
private vehicles and adult prisons.
Smoking in all indoor public places will be banned. Pubs,
restaurants and nightclubs will feel the largest impact of the
smokefree ban.
Smokefree
vehicles
The
new law requires vehicles to be smokefree
at all times when used:
-
to transport members of the public
-
for paid or voluntary work by more than 1 person, whether they
are in the vehicle at the same time.
Vehicles used primarily for private purposes are not be required to
be smokefree.
Fines for non-compliance?
Enforcement of No Smoking regulations will be carried out by
Environmental Health Officers who will issue the following
penalties:
-
Smoking in a smoke free premises or vehicle: -
fixed penalty notice of £50 for the person caught smoking, up to
£200 if prosecuted and convicted by a court.

Failure to display no smoking sign: - £200.
This can go up to £1000 if the case is taken to court.

Failing to prevent smoking in a smoke free
place: - £2,500.
What do I need to do to comply?
The new law
will require no smoking signs to be displayed in all
smokefree premises and vehicles.
What signage do I have to display?
The
smoking ban requires no-smoking signs to be displayed in all
smokefree premises and vehicles. Signs
are required to make it clear which premises and vehicles are
smokefree, whilst demonstrating steps
taken to fulfil the requirements set by
law.
No smoking signs will need to be displayed in a prominent position
at every entrance to smokefree premises.
Signs must meet the following minimum requirements:
-
be a minimum of A5 in area (210mm x 148mm)
-
display the international no-smoking symbol* at least
70mm in diameter
-
carry the following words in characters that can be easily read:
- No smoking. It is against the law to smoke in these premises
A
smaller sign consisting of the international no-smoking symbol at
least 70mm in diameter may instead be displayed at entrances to
smokefree premises that are:
-
only used by members of staff. providing the premises displays
at least one A5 area sign, or
-
located within larger smokefree
premises, such as a shop within an indoor shopping
centre.
Required signage for smokefree vehicles
Smokefree
vehicles will need to display a no-smoking sign in each compartment
of the vehicle in which people can be carried. This must show the
international no-smoking symbol at least 70mm in diameter.
