All goods will remain the property of Risk Assessment Products, until payment
in full has been cleared and as detailed in the Licence Agreement.
Risk Assessment Products does not operate a Sale & Return policy.
You the purchaser are licensed to use the Risk Assessment Products Software, which contains training programmes for a period of one year from the date of purchase and train (where applicable up to 99 persons per site), (See license Agreement). You can use one copy of the Software on a single computer, 10 computers if the purchased
product is or contains the Workstation Welfare software title. If you plan to
operate the Software on a network, or require a multi-user licence, please
contact us via email requesting a site or multi-user licence.
Note all software displayed on this site is only licensed for use and operation
for 12 months and will only operate for 12 months only from initial purchase /
key code activation. You can then purchase a new / updated (where applicable)
product.
All software returned faulty must be returned in original packaging. Any CD-ROM
found to be non-working i.e. (DOA) must be returned to base within 7-days of
purchase.
All returned software would be tested before replacement return being made. NOTE
any CD-ROMs returned tested not faulty; no refunds will be given.
Software returned due to incompatibility with the Purchasers original equipment
a restocking fee of 50% may be made, or a replacement (if available).
In the event of an item being returned found to be faulty which we no longer
stock & subsequently has to be returned to our suppliers/manufacturer we reserve
the right to replace the said item within 21 days by a similar titled software
product.
Before any item is tested & or replaced it must be returned in the condition as
per paragraph 3 & a copy of the original invoice. Your invoice is your
GUARANTEE.
Multi User License. Where a multi user license is granted, the initial license
fee includes an agreed supply of software followed by an agreed annual license
fee. The initial license fee covers a period of 1 year, thereafter Risk
Assessment Products reserves the right to renegotiate the Annual and multi-user
license fee. Note unless otherwise stated any multi user license issued is
strictly for use as a named site license or for the premises/address as detailed
within the quotation agreement.
In the event that the purchaser wishes to distribute the Risk Assessment
Products, in all circumstances the purchaser must have a valid Distribution
Heads of Agreement, Terms and Conditions of which apply in full. If granted, as
an interim measure for marketing trials purposes etc, where a
Distribution/reseller Agreement does or does not exist, Risk Assessment Products
reserve the right to amend/remove exclusivity clauses, withdraw distribution
rights, supply of products and services at any time.
Risk Assessment Products unless otherwise agreed formally in writing operates a
free trade policy in that all marketing agreements are strictly non-exclusive.
In the event that Risk Assessment Products agrees an exclusive marketing
agreement in writing, exclusivity provisions last only for a maximum period of
12 months from the date of the Heads of Agreement/marketing agreement.
Thereafter unless otherwise further agreed in writing all further extended
annual marketing agreements are to be classified as strictly non-exclusive. Any
agreement regarding commissions or remunerations through sales or
introduction/finders fees or such like must be formally agreed in writing by
Risk Assessment Products.
Protector International Ltd reserves the right to change the product contents
and/or price of any product or service at any time, without prior notification.

WARRANTY AND LIABILITY
Limited Warranty. Risk Assessment Products The Licensor (jointly and severally)
warrants the physical diskette and physical documentation enclosed herein to be
free of defects in materials and workmanship for a period of 14 days from the
date of purchase by the end user. Protector International Ltd has provided this
Software as a general guide to assist management, in all cases users must ensure
and comply with current legislative entitlements and regulations before
completing the documents. Whilst this Software and documents are comprehensive,
users should in all cases satisfy themselves that the arrangements and
procedures detailed within this Software are suitable and sufficient for their
intended application and meet current regulations. Users are to seek specialist
advice where special conditions and risk exist. Errors or omissions are to be
notified to Risk Assessment Products.
To the maximum extent permitted by applicable law, Risk Assessment Products
shall not be liable by reason of any representation (other than a fraudulent
representation) or implied warranty condition or other term or any duty at
common law or under the express terms of this licence for any consequential loss
or damage (whether for loss or profit or otherwise and whether occasioned by the
negligence of Risk Assessment Products or its employees, distributors or agents
or otherwise) arising out of or in connection with any act or omission of Risk
Assessment Products relating to the manufacture, supply or content of the
Products, their resale by a distributor or their use by any customer/user,
Nothing in this agreement shall limit or exclude or be deemed to limit or
exclude any liability of Risk Assessment Products in respect of death or
personal injury caused by the negligence of Risk Assessment Products. Further,
neither Risk Assessment Products, nor its servants, suppliers and distributors
shall be liable for any indirect or consequential liability damage or loss
howsoever caused arising out of the use of this Software and accompanying
written material, or for any claim (whether direct or indirect) for loss of
profit, or loss of data, or other similar claims, even if Risk Assessment
Products are specifically advised of the possibility of such damages. If and to
the extent that Risk Assessment Products shall have any liability for any
damages to you or any other person such claim shall not exceed the money paid
for the Software.
